Here is just small a sampling of cases that Mr. Weinreb has successfuly litigated:

 

  • Successful in obtaining real estate reductions for businesses (tax certiorari cases) and other commercial properties, including obtaining a favorable court ruling in an important precedential reported case on a business real estate tax appeal related to the issue of "Welcome Stranger". 

 

  • Succeeded in having a court overturn the decision of one zoning board relating to the grant of a variance.

 

  • ERISA Benefits: Assisted individuals who were denied pensions, long-term disability benefits, etc.

 

  • Defended a company against collective action for alleged violations of the minimum wage and overtime rules under the FLSA (Fair Labor Standards Act).

 

  • Defended a company against allegation that it sold defective goods to another company.

 

  • Several victories in court and before administrative agencies defending sexual harassment, employment, discrimination and FLSA claims.

 

  • Defended claim that a non-competition agreement was breached.

 

  • Succeeded in obtaining one of the largest jury awards in a defamation action in Rockland County's history.

 

  • Succeeded in overturning decision of assessor denying parsonage exemption.

 

  • Successfully represented minority shareholders in their legal claims against corporation.

 

  • Successfully obtained a 24% tax reduction to shopping center that had been paying approximately $270,000 of property taxes per year.

 

  • Successfully obtained significant real estate tax reduction for owner of more than 100 condominium units with respect to its units in condominium complex

 

  • Was successful in court in preventing a religious entity from having its property foreclosed.  

 

  • Successfully overturned in court municipality's denial of tax exemption to religious school. 

 

 

REPORTED CASES:

  • Matter of AKW Holding LLC v. Assessor of the Town of Clarkstown, 12 Misc.3d 1160A; 619 NYS2d 2008, 2006 NY Slip Op  50976U (Supreme Court Rockland 2006) - We were successful in challenging Clarkstown’s assessed valuation of commercial property. The Court ruled in favor of our claim that the Assessor's methodology of bringing the assessed value of properties in line with the assessed value of other similar properties in the Town of Clarkstown, in the absence of a town-wide revaluation program, was unfair, unreasonable, and discriminatory, and was not applied even-handedly to all similarly situated property. 

 

  • Congregation Knesset Israel  v. Assessor of Ramapo, 8 Misc.3d 1021A, 803 NYS2d 17, 2005 NY Misc. Lexis 1593, 2005 NY Slip Op. 51218U (Supreme Court Rockland 2005) – A parsonage tax appeal case.

 

  • Iannaccone v. 21st Century Open MRI, P.C., 8 AD 3d 233, 777 N.Y.S.2d 315 (2d Dep't 2004) -  Successful at trial and in the Appellate Division in upholding a jury verdict in a defamation case involving a doctor and his employee. 

 

  • Boyce v. New York City Health & Hosps. Corp., 8 AD 3d 220, 777 N.Y.S. 2d 659 (2d Dep't 2004) – Successfully had the Appellate Division Second Department overturn decision of lower court denying pension benefit claims of four doctors.

 

  • Parker v. Reliance, 2000 U.S. Dist LEXIS 784 (SDNY 2000) - We successfully overturned the insurance company’s denial of long-term disability benefits to our client, who was suffering from congestive heart failure. 

 

  • Benjamin v. Brookhaven Sci. Assocs., 387 F.Supp. 2d 146, 2005 U.S. Dist. LEXIS 18329 (EDNY 2005) - A race discrimination case in the federal district court in Central Islip, New York.

 

  • Sklaver v. Casso-Solar Corp., 2004 U.S. Dist. LEXIS 24934 (SDNY 2004) – An age discrimination case. 

 

  • Rajcoomar v. TJX Cos., 319 F.Supp. 2d 430 (SDNY 2004) – A race and national origin case in White Plains, NY.

 

  • Chamblee v. Harris & Harris, Inc., 154 F.Supp. 2d 670 (SDNY 2001) – In the Southern District of New York in White Plains, New York, successfully defended a summary judgment challenge in a sexual harassment case. 

 

  • Gavigan v. Clarkstown Cent. Sch. Dist., 84 F.Supp2d 540 (SDNY 2000) – An age discrimination case. 

 

  • Barnett v. Revere Smelting & Refining Corp., 67 F.Supp. 2d 378 (SDNY 1999) – A Family Medical Leave Act and disability (FMLA) case.
